'Disappeared' Victims Of Mexico's Drug War Await Justice From New Administration

Human rights advocates are beginning to uncover evidence of widespread abuses against civilians committed by various entities within the military and law enforcement during the administration of former President Felipe Calder?n.

The international advocacy group Human Rights Watch has documented in a new report nearly 150 unsolved cases of enforced disappearances since 2007, saying it found ?compelling evidence of ? the participation of state agents,? including the army, navy, federal and local police.

?Throughout most of his presidency, Calder?n denied security forces had committed any abuses, despite mounting evidence to the contrary,? read a summary of HRW?s report, titled ?Mexico?s Disappeared: The Enduring Cost of a Crisis Ignored.?

?Only in his final year did he acknowledge that human rights violations had occurred, and take a handful of positive -- though very limited -- steps to curb some abusive practices,? it continues. ?However, he failed to fulfill his fundamental obligation to ensure that the egregious violations committed by members of the military and police were investigated and the perpetrators brought to justice.?

Human Rights Watch also said that the responsibility to solve these cases has now fallen upon Pe?a Nieto?s administration, which took office last December, adding that a failure to address this issue -- which it calls ?the most severe crisis of enforced disappearances in Latin America in decades? -- will only perpetuate it.

?If the Pe?a Nieto administration repeats this mistake -- and fails to set out a comprehensive, effective plan to investigate past disappearances and help prevent them in the future -- cases of disappearances will almost certainly continue to mount,? the reports reads. ?And thousands of victims? families will continue to endure the agony of not knowing what happened to their loved ones.?

Pe?a Nieto has pledged to reduce the escalating violence arising from Mexico?s drug war that has claimed some 70,000 lives since 2006, when Calder?n took office and deployed the armed forces at home in an intensification of the government?s operations against the country?s powerful drug trafficking organizations, commonly referred to as ?cartels.?

In its report, HRW says that along with the escalation in violence from the drug war, the number of cases of alleged abuse of civilians by Mexico?s security forces has risen dramatically.

?The nearly 250 disappearances documented in the report do not represent all of the cases in Mexico since 2007,? it says. ?On the contrary, official statistics leave little doubt that there are thousands more. A provisional list compiled by the Federal Prosecutor?s Office and the Interior Ministry of more than 25,000 people who were ?disappeared? or reported missing since 2006 was leaked to the media in November 2012.?

Human Rights Watch says it was only able to confirm involvement of state security forces in 149 of the cases it investigated, though it suspects their involvement in many more -- still, overall, the powerful drug cartels are suspected of being behind a large number of these disappearances.

But in at least 60 of the cases it investigated, HRW found evidence of collaboration between state agents and criminal organizations to extort the families of those disappeared.

Its report added that arbitrary detentions of civilians by security forces are often involved in cases of disappearances.

?The majority of the likely enforced disappearance cases we documented follow a pattern,? HRW noted. ?Members of security forces arbitrarily detain individuals without arrest orders or probable cause.?

?When victims? relatives inquire about detainees? whereabouts at the headquarters of security forces and public prosecutors? offices, they are told that the detentions never took place,? it adds.

The rights group has urged the Mexican government to end this practice by mandating the immediate presentation of all detainees before a public prosecutor?s office, which it said would help reduce disappearances.

To this end, it also has suggested the establishment of a national database for disappeared persons that would help investigators solve such cases.

In a bid to reduce violence related to the drug war, Pe?a Nieto announced that he aims to return Mexican troops to their barracks and establish a new national police force to secure areas controlled by the cartels and carry out targeted operations.

Fans looking forward to the game have every right to wonder what the hell is going on, then, and to them, Sony Worldwide studios boss Shuhei Yoshida would like to say he's sorry.

In an interview with Kotaku at the PS4 reveal in New York, Yoshida said "I apologize to people who are waiting for the game. Ueda-san posted that he's still working on it, that he's creative-directing it and that the team in the Japan studios are working hard. We are waiting for the right time to re-introduce The Last Guardian."

Asked about whether the game might now be for the PlayStation 4, and not the PlayStation 3 as originally intended, Yoshida would only say "We're going to talk about it when we can."

Given there's so much more to find out about the PS4, you could hope that time would be E3. If, that is, you've got any hope left in the tank for this game.

Criminal charges dropped against Chevron in Brazil

SAO PAULO (AP) -- A Brazilian federal court has dismissed criminal charges filed last year against Chevron Corp., driller Transocean Ltd. and several of their executives in connection with a 2011 oil spill off the coast of Rio de Janeiro.

The two companies and 17 of their executives had been charged with "crimes against the environment" and faced up to 31 years in prison if convicted.

Judge Marcelo Luzio sent the charges back to prosecutors, who have five days to appeal his ruling, a court official said Thursday. The official did not provide further details. She spoke on condition of anonymity because she was not authorized to speak to the news media.

The prosecutor's office said it would not have any immediate comment.

Chevron said in a statement that it was pleased by the court's decision and that it remained "committed to its policy of full transparency and close cooperation with Brazilian authorities."

Transocean said it welcomed the ruling, which it said showed that "Transocean's crew members did exactly what they were trained to do, acting responsibly, appropriately and quickly while always maintaining safety as their top priority."

The companies still face two civil lawsuits seeking $20 billion in damages for the spill, in which about 155,000 gallons of crude oil leaked from the seabed near a Chevron well off the coast in November 2011.

"Both sides are seeking an agreement regarding the amount to be paid," said Marcelo Del Negri, a spokesman at the federal prosecutor's office. "All I can tell you is that they have offered to pay far less than what we want ? about $160 million."

BUFFALO, N.Y. --?Sunday night's carbon monoxide scare at UB's North Campus could prompt change in?college dorms across the state.

Several students were sickened when CO leaked from a boiler in the Richmond Quad Housing Area.

University officials tell 2 On Your Side that hard-wired carbon monoxide detectors were not in the dormitories because they are not mandated by law. They do have several plug-in units near possible CO sources, such as boilers and laundry rooms.

Joseph Brennan, UB's Associate Vice President for University Communications, says that this incident is a call to action and they will begin installing integrated, hard-wired smoke, heat and CO detectors in all dormitory buildings in the next few weeks.

Now, several state lawmakers and Ken Hansen, who lost his daughter Amanda to CO Poisoning a few years ago, want to amend?Amanda's Law to make the hard-wired detectors mandatory in all college dorm rooms in New York.

As Cuts To Special Education Loom, Congress Takes Break

Within days, severe budget cuts are slated to hit nearly every federal program ? including special education and other disability supports ? and there?s no sign of a deal on the horizon.

The sweeping automatic spending cuts will take effect March 1 unless Congress acts. For people with disabilities, the across-the-board reductions are expected to touch everything from employment assistance to housing programs, education, mental health initiatives and research dollars.

The funding chop is coming under a process known as sequestration, which was triggered in 2011 after Congress failed to reach a budget deal. The cuts were designed to be so dire that neither political party would want them to go through and the two sides would be forced to reach a deal. So far, however, that has not happened. Lawmakers already delayed the cuts once when they were were originally scheduled to take effect in January, but now hopes are dimming that another deal with be struck to avert the reductions.

SUV opens fire on Maserati on Vegas strip, killing 3

LAS VEGAS (AP) ? Gunshots fired from a black Range Rover on the Las Vegas Strip early Thursday caused a Maserati to crash into a taxi, creating a fireball and killing three people as the SUV sped away.

Initial reports had it as a gunfight between the luxury SUV and the high-end sports car. But investigators don't think anyone in the Maserati was shooting, said Sgt. John Sheahan.

Police are looking for the distinctive black Range Rover with dark tinted windows and black rims that left the scene after the 4:30 a.m. Thursday crash at the intersection of Flamingo and Las Vegas boulevards. It's surrounded by some of the most famous casinos on the Strip, including the Bellagio, Caesars Palace and Bally's.

In all, five vehicles were involved. The Maserati driver, the taxi driver and a passenger in the cab were killed.

The Range Rover has paper dealer plates, although it's not clear what state they're from, police said. Authorities are checking with law enforcement agencies in California, Arizona and Utah in their search for clues.

The taxi was affiliated with the Desert Cab company, according to general manager Sandy Shaver. He declined to comment further.

Several people were taken to the hospital, including a passenger from the Maserati. Four were taken to University Medical Center where spokeswoman Danita Cohen said three people were treated and released. One person remained in the hospital whose condition was not released.

The intersection is expected to be closed for hours as officers investigate.

A tourist who witnessed the aftermath of the crash told KLAS-TV the burning taxi looked like a fireball.

It's the latest in a series of violent actions on the tourist corridor since the beginning of the year. Two people were critically wounded in a shooting at a parking garage Feb. 6, and a tourist was stabbed in an elevator at The Hotel at Mandalay Bay Feb. 16.

A spokesman for the Las Vegas Convention and Visitors Authority, Jeremy Handel, said his organization didn't immediately have a comment on the incident and deferred to the police unit that patrols the tourism district.

Cherchez Les Femmes: Paris May Elect Female Mayor Next Year

The decision by the current mayor, Socialist Bertrand Delan?e, not to run for re-election next year after serving for 12 years has opened up the floodgates for women seeking to grab the levers of power in a country where the fairer sex has traditionally been politically marginalized.

No woman has ever served as Paris mayor.

Anne Hidalgo, the Socialist candidate and current deputy mayor, will face two center-right hopefuls, the front-runner Rachida Dati, 47, a former member of Nicolas Sarkozy?s cabinet; and MP Nathalie Kosciusko-Morizet (better known as NKM), 39, Sarkozy's former campaign spokesman and environment minister.

In a way, these ladies serve as kind of proxies for men already ensconced in power.

For example, NKM has the endorsement of former Prime Minister Fran?ois Fillon, who reportedly has tense relations with Dati. Conversely, the glamorous and ambitious Dati enjoys the support of Jean-Fran?ois Cop?, with whom Fillon was locked in a bitter battle for the leadership of Sarkozy?s Union for a Popular Movement (UMP) party.

Meanwhile, Hidalgo, 53, is closely allied with President Fran?ois Hollande, but has never held any elected office, although she is viewed as Delanoe?s hand-picked successor.

Currently the mayor of Paris? VII arrondissement and a member of the European Parliament, Dati, once a rising star in Sarkozy?s administration, suffered a dramatic fall, when Sarkozy?s wife, Carla Bruni, reportedly viewed her as a threat, leading to Dati losing her coveted post as justice minister.

A dark-horse fourth candidate is 37-year-old Green party favorite C?cile Duflot, the current minister of territorial equality and housing.

?I'm not ruling anything out,? Duflot told the French newspaper Journal du Dimanche.

Daniel Cohn-Bendit, a Green Euro MP, told the Daily Telegraph, he looked forward to the all-woman mayoral campaign.

"Perhaps they will show that one can have different projects, do politics differently between women by being competitors without being adversaries," he said.

Although there is still time for a man to throw his hat into the ring, the likelihood of a woman gaining one of the most prestigious political jobs in France would be a historic event.

?The mayor of Paris has a lot of political clout, much more than London, so having a woman in that position will certainly help boost the presence of females in French politics,? Philippe Marli?re, a professor in French politics at UCL London, told The Local newspaper.

?You can introduce all kinds of laws on equality but this kind of scenario will help much more.?

Marli?re added that it would be conceivable for a woman to one day become France?s president.

?I think it?s definitely in the pipeline,? he said. ?I don?t think the French are ready to elect a president from an ethnic minority like [a Barack Obama] figure, but they?re much closer to having a female president.?

Dati is by far the most compelling and fascinating figure in this unfolding political melodrama.

Born to North African parents (a Moroccan father and Algerian mother) in humble circumstances, Dati attracted salacious headlines over a lawsuit she filed charging that Dominique Desseigne, a wealthy hotel magnate and chief executive of Groupe Lucien Barri?re, is the father of her child.

Dati, who will likely face a bitter and tough primary against NKM for Paris' ever- dwindling conservative vote, has been criticized by the French media for her excessive attention to elegant fashion, frequently wearing clothes designed by Christian Dior.

Bhaskar Jadhav junks fat wedding charge, says will quit if proved wrong

Refuting the allegation that an irrigation department contractor had sponsored his children?s weddings, minister of state for urban development Bhaskar Jadhav on Tuesday said that he would quit public life if the allegation was proved correct.

?If it is proved that an irrigation contractor named Shah spent for my children?s wedding, I will not let anyone ask for my resignation, (instead) I will quit political life,? he said.

Jadhav has come under scrutiny following the lavish weddings that were solemnised last week. On Monday, the IT department conducted raids in his properties at Chiplun in Ratnagiri and Karad in Satara.

Continuing its action on Tuesday, the department conducted raids at the properties of a person identified as PC Shah. The raids were carried out at his residential bungalow ?Pushpak? in Karad and his hotel ?Pankaj? on the Mumbai-Bangalore highway near Karad. Sources say that in a day-long search, teams of the department scrutinised some data stored in a computer.

In Chiplun, they recorded the statements of two persons identified as Joshi and Pilpile. Both own land the in partnership where the extravagant weddings had taken place.

If you prefer cycling, rock climbing, but those activities (or any other) exacerbates your condition, reduce the frequency of the activity.?

Ice or heat?
Both ice and heat have their merits when treating arthritis. Like treating an injury, ice seems to be more effective for reducing inflammation and swelling and numbing pain, especially when symptoms appear in the first 24-48 hours.? Heat, on the other hand, tends to work best for relaxing muscles and stiff joints by increasing blood flow and flexibility.

Reduce exposure to pollutants and help purge your body of poisons
Even if you eat a wholesome diet loaded with antioxidants, if you are exposed to high levels of environmental pollutants such as mercury, lead, aluminum and inorganic plastic compounds, you may still develop arthritis. Various lab tests can analyze the amount of chemicals in your body. Your cookware can also be a common source of poisons entering your body.? High blood levels of a man-made chemical (Teflon) used in non-stick coatings are associated with a raised risk of arthritis.

Tunisia PM fails to get new cabinet to stem unrest

TUNIS (Reuters) - Tunisia's main political parties failed to agree on forming a non-partisan cabinet to tackle turmoil triggered by the assassination of an opposition leader, Prime Minister Hamadi Jebali said on Monday.

But he said efforts would continue to form a government supported by most parties in the North African state that spawned the slew of popular uprisings against dictatorship across the Arab world two years ago.

Tunisia was pitched into crisis last week after leading secular opposition politician Chokri Belaid was gunned down outside his home in Tunis, touching off mass protests targeting in part the ruling moderate Islamist party.

"The initiative for a cabinet of technocrats did not receive full political consensus and has failed...But work is continuing with all parties to form a government which has the agreement of most of the political parties," Jebali told a news conference.

He spoke after a meeting with leaders of secular political parties and his own Islamist Ennahda party, which has denied any involvement in Belaid's killing.

Jebali suggested a cabinet of apolitical technocrats to help restore calm and guide Tunisia to elections. He had threatened to quit if his proposal failed but on Monday he said only: "I will meet the president tomorrow to discuss the next steps."

The political crisis has disrupted efforts to revitalise an economy that was hard-hit by the disorder that followed the overthrow of veteran strongman Zine al-Abidine Ben Ali in 2011.

Tunisia has been negotiating with the International Monetary Fund for a $1.78 billion loan, and politicians said Jebali's inability to re-establish a functioning government was retarding economic rebuilding efforts.

"The political and economic cost of this failure will be expensive especially that the country's economy is in a difficult situation and the governance crisis will deepen doubt," Issam Chebbi, a secular Republican party leader, said.

Jebali's own Ennahda party rejected his idea of a technocratic government.

Ennahda party chief Rached Ghannouchi told Reuters it was essential that Islamists and secular parties shared power now and in the future. "Any stable rule in Tunisia needs a moderate Islamist-secular coalition," he said.

Ghannouchi said Ennahda might compromise over control of portfolios such as defence, foreign affairs, justice and interior. "We are ready to discuss all ministries, including sovereign ones, in a new coalition government."

Violent protests, in which one policeman was killed, swept Tunisia after Belaid's assassination, with crowds attacking Ennahda offices in Tunis and elsewhere. Tens of thousands of people turned out for the slain leader's funeral on Friday.

Tunisia's political transition has been more peaceful than those in other Arab nations such as Egypt, Libya and Syria. But tensions are smouldering between Islamists elected to power and liberals who fear the loss of hard-won liberties.

Meningiomas are the commonest form of tumour affecting the brain and spine. Usually meningiomas can be removed by surgery and do not recur. Occasionally people can develop more than one meningioma or many members of the same family can be affected.

A team led by Dr Miriam Smith, Professor Gareth Evans and Dr Bill Newman worked with families with a history of meningiomas affecting the spinal cord. Using a powerful new genetic sequencing technique called next generation sequencing, they were able to check all the genes of three individuals with multiple spinal meningiomas. This lead to the identification that changes in a gene called SMARCE1 lead to spinal meningiomas in some families.

In December 2012 the government announced a focus on genetic sequencing with an aim of sequencing the genomes (a person's DNA) of 100,000 Britons with cancer and rare diseases in UK centres. The voluntary sequencing of patients will lead to better testing, better drugs and above all better care for patients. Manchester is already using this technology in their well established Genetics department at Saint Mary's and it is enabling doctors to ensure patients have access to the right drugs and personalised care quicker than ever before.

In the past year 10 genes have been discovered using the new next generation sequencing technology in Manchester including genes for developmental problems, deafness, short stature and bladder problems that lead to kidney failure.

"With our new DNA sequencing machines, we have been able to show that changes in the SMARCE1 gene are responsible for multiple spinal meningioma disease," said Dr Smith. "Before our work, doctors did not know that inherited spinal meningiomas have a completely different cause to other tumours affecting the brain and spine.

"The next step is to develop a screening programme to assess the risk of developing spinal tumours for individuals in affected families, and to investigate possible treatments to prevent the spinal tumours from growing."

Such detailed molecular characterisation underpins current thoughts about how meningioma and cancer will be managed in the future and is at the heart of the personalised medicine approach."

Just over two people in every 100,000 develop meningiomas in the head and spine, with twice as many women as men diagnosed with the condition.

Tunisia PM fails to get new cabinet to stem unrest

TUNIS (Reuters) - Tunisia's main political parties failed to agree on forming a non-partisan cabinet to tackle turmoil triggered by the assassination of an opposition leader, Prime Minister Hamadi Jebali said on Monday.

But he said efforts would continue to form a government supported by most parties in the North African state that spawned the slew of popular uprisings against dictatorship across the Arab world two years ago.

Tunisia was pitched into crisis last week after leading secular opposition politician Chokri Belaid was gunned down outside his home in Tunis, touching off mass protests targeting in part the ruling moderate Islamist party.

"The initiative for a cabinet of technocrats did not receive full political consensus and has failed...But work is continuing with all parties to form a government which has the agreement of most of the political parties," Jebali told a news conference.

He spoke after a meeting with leaders of secular political parties and his own Islamist Ennahda party, which has denied any involvement in Belaid's killing.

Jebali suggested a cabinet of apolitical technocrats to help restore calm and guide Tunisia to elections. He had threatened to quit if his proposal failed but on Monday he said only: "I will meet the president tomorrow to discuss the next steps."

The political crisis has disrupted efforts to revitalize an economy that was hard-hit by the disorder that followed the overthrow of veteran strongman Zine al-Abidine Ben Ali in 2011.

Tunisia has been negotiating with the International Monetary Fund for a $1.78 billion loan, and politicians said Jebali's inability to re-establish a functioning government was retarding economic rebuilding efforts.

"The political and economic cost of this failure will be expensive especially that the country's economy is in a difficult situation and the governance crisis will deepen doubt," Issam Chebbi, a secular Republican party leader, said.

Jebali's own Ennahda party rejected his idea of a technocratic government.

Ennahda party chief Rached Ghannouchi told Reuters it was essential that Islamists and secular parties shared power now and in the future. "Any stable rule in Tunisia needs a moderate Islamist-secular coalition," he said.

Ghannouchi said Ennahda might compromise over control of portfolios such as defense, foreign affairs, justice and interior. "We are ready to discuss all ministries, including sovereign ones, in a new coalition government."

Violent protests, in which one policeman was killed, swept Tunisia after Belaid's assassination, with crowds attacking Ennahda offices in Tunis and elsewhere. Tens of thousands of people turned out for the slain leader's funeral on Friday.

Tunisia's political transition has been more peaceful than those in other Arab nations such as Egypt, Libya and Syria. But tensions are smouldering between Islamists elected to power and liberals who fear the loss of hard-won liberties.

Russian scientists recover meteor fragments

MOSCOW (AP) ? Scientists have found more than 50 tiny fragments of a meteor that exploded over Russia's Ural Mountains, and preliminary tests are turning up information about its contents.

However, local residents seem more interested in the black market value of the fragments. As they search for their own pieces of the meteor, sales offers already are filling the Internet, and police are warning all purchasers to prepare for possible fraud.

The meteor ? which injured nearly 1,500 people and caused widespread property damage in Chelyabinsk city on Friday ? was the largest recorded space rock to hit Earth in more than a century. Health officials said 46 of the injured remain hospitalized.

Viktor Grokhovsky, who led the expedition from Urals Federal University, said Monday that 53 fragments of the meteor have been plucked from the ice-covered Chebarkul Lake. He said they are less than a centimeter (half an inch) in size, about 10 percent iron, and belong to the chondrite type, the most common variation of meteorites found on Earth.

Friday's meteor left a six-meter-wide (20-foot-wide) hole in the ice covering the lake. Divers inspecting it have found nothing at the bottom, but Grokhovsky said a fragment as large as 50-60 centimeters (20-24 inches) could eventually be found there.

Meanwhile, workers in the city remained busy replacing acres of windows shattered by a powerful shockwave caused by the meteor's strike, which NASA said released 500 kilotons of energy, the power equivalent to more than 30 Hiroshima bombs.

The local governor estimated the damage at 1 billion rubles ($33 million) and said he hopes the federal government will provide at least half that amount.

Lidiya Rykhlova, head of the astronomy department at the Moscow-based Institute for Space Research, said experts have drafted a program that envisages building new powerful telescopes, including space-based ones, to warn against potentially dangerous asteroids, comets and other threats. The 10-year program would cost 58 billion rubles ($1.9 billion).

That huge price tag has raised many eyebrows, drawing a sarcastic post from Alexei Navalny, an anti-corruption crusader and opposition leader. "You'd better fix roads in Chelyabinsk. Holes on them cause more damage than 100 meteorites," he said.

Rykhklova, speaking to online Gazeta.ru, dismissed Navalny's sarcasm, saying the Chelyabinsk fireball highlighted the need for quick creation of such an early warning system.

India cracks down on taxation of transfers within foreign firms

MUMBAI (Reuters) - India is aggressively pursuing tax claims against multinational firms operating in the country as the government seeks to rein in its budget deficit, taking particular aim at IT and back-office functions, tax officials say.

It has targeted several multinational companies in recent years for tax audits on transfer-pricing, but over the past 12 months has widened the scope of the investigations, tax officials said.

Authorities are now checking deals involving more than three dozen companies, focusing on transactions worth at least 250 million rupees ($4.7 million), officials said. Having just issued claims for the financial year to March 2009, it has shifted focus to 2009/2010.

Transfer pricing is the value at which companies trade products, services or assets between units across borders, a regular part of doing business for a multinational.

Revenue authorities in many countries including Britain, France, Germany and the United States are increasingly challenging efforts of companies to minimize tax liabilities by moving taxable income from higher-taxing jurisdictions to lower-tax ones.

In India's case, critics worry overly aggressive tax authorities could undermine foreign investment although tax officials say they have been working overtime as Finance Minister P. Chidambaram looks to make up a revenue shortfall and head off the threat of a credit rating downgrade.

"On some days we had to work through the night to meet the deadline," said one official. "There are so many cases that are coming to us but we don't have an adequate number of people."

At least 1,500 transfer pricing disputes were in litigation in India as of February 2011, compared with fewer than six in the United States and none in Taiwan or Singapore, an Ernst & Young survey showed in August 2012. Still, Western campaigners say BRIC countries - Brazil, Russia, India and China - are tougher on corporate tax avoidance than developed countries.

One company in the cross hairs, Anglo-Dutch oil major Royal Dutch Shell , said earlier this month it would challenge a claim its local unit underpriced shares transferred to the parent by $2.8 billion. Shell said the claim is based on an "incorrect interpretation" of tax rules and "bad in law".

Shell said its India unit issued 870 million shares to parent Shell Gas BV at 10 rupees apiece in 2009 but that tax authorities valued them at 183 rupees each.

Effectively, India is demanding the tax on the interest Shell would have earned on the $2.8 billion, in the largest ever claim in an Indian transfer pricing case, tax officials said.

South Korea's LG Electronics Inc , Singapore property group Ascendas, French IT services firm Capgemini and chocolate maker Cadbury, are among numerous global companies involved in transfer pricing disputes in India, documents at the tax department's appellate tribunal show. These companies have challenged the tax department's orders.

In information technology and business process outsourcing (BPO), the tax department believes many firms are taking advantage of low costs in India to develop high-end, patented services or products that are sent to overseas parent firms as low-value routine work, the tax officials said.

These sectors are expected to account for more than half the total claims in transfer pricing deals in the fiscal year 2008/09, one of the officials said, up from about one-third earlier.

Outsourcing makes up more than $100 billion of India's economy with companies such as Accenture , Bank of America Merrill Lynch , and Microsoft Corp employing thousands in functions such as customer service, risk and fraud management and finance and accounting.

A spokeswoman for the National Association of Software and Services Companies said the Indian outsourcing lobby group was concerned tax authorities have been making "inconsistent and very aggressive adjustments."

HOT TAX ISSUE

Because valuing an internal transaction is often a matter of opinion and assumption of future growth, companies and tax authorities can arrive at widely divergent views on their value.

"Some of their decisions on valuations are very arbitrary and obviously may not be sustainable at higher appellate levels," said Sanjay Tolia, partner for transfer pricing at Price Waterhouse & Co in Mumbai.

In LG Electronics' case, tribunal documents show the company's Indian unit was deemed to be promoting the LG brand owned by its parent, which should have compensated the local unit, thereby generating taxable income. Authorities claim the excess expenditure amounted to a transfer pricing adjustment of 1.61 billion rupees.

Earlier this month, British-based mobile phone giant Vodafone Group Plc said it had received a fresh transfer pricing order in India over the issue of shares by a unit, adding to its tax woes in the country. India's tax office says the Vodafone unit under-priced shares issued to a Mauritius-based group company by nearly 13 billion rupees ($244 million), ET NOW TV station reported recently. Vodafone said it would challenge the order.

Vodafone is already fighting a transfer pricing case in the Bombay High Court that involves a $1.6 billion disagreement, a person with direct knowledge of the matter said. The company declined to comment.

India is also trying to claim more than $2 billion in tax stemming from Vodafone's 2007 acquisition of an Indian mobile company from Hong Kong's Hutchison Whampoa Ltd .

Vodafone says share subscriptions are not covered by either Indian or international rules on transfer pricing so the latest order had "no basis in law".

Tax officials say that while shares are not taxable, the department is increasingly clamping down on under-priced share deals on the premise that it is losing out on taxing the interest that the adjusted amount would have earned.

Still, consultants say the department's argument would not stand the test of law.

Cadbury said it has challenged a ruling made against it for 2007-08 and that India's income tax tribunal had granted a stay on the demand upon payment of less than 10 percent of the amount.

The income tax department argues the local unit overpaid its parent for brand royalty and service fees, thereby lowering its profit in India and resulting in a lower tax obligation.

"It is not uncommon that the income tax department and a tax payer have a difference of opinion on the interpretation of tax laws," Cadbury said in a statement to Reuters.

Ascendas and Capgemini also declined to comment.

The average corporate tax rate in Asia in 2013 is 22.89 percent while in Europe it is 20.49 percent, compared with 32.45 percent in India, KPMG says.

LG to release full HD smartphone in SKorea

SEOUL, South Korea (AP) -- LG Electronics Inc. said Monday its new smartphone with a full high-definition screen will go on sale in South Korea this week before hitting shelves in Japan in April.

The Optimus G Pro smartphone features a 5.5-inch screen that packs over 2 million pixels, or twice as many as smartphones with HD screens.

The new Android-powered phone sports other upgrades including a camera that can shoot full HD videos and photographs.

The South Korean company, Sony Corp., HTC Corp. and other phone manufacturers are trying to make high-resolution screens a key feature in their new smartphones this year.

Full HD screens are more common in televisions but smartphone makers began to embrace them this year amid cutthroat competition. One in every two smartphones is made by Samsung Electronics Co. or Apple Inc., creating a hardscrabble fight among the second-tier of makers.

LG executives said their current goal is elevating the reputation of the Optimus brand after turning around the company's mobile communications business following years of losses.

The Optimus G Pro is available at 968,000 won ($894) without in South Korea without a mobile carrier contract.

The model will be on display at the annual mobile fair in Barcelona, Spain kicking off next week.

Once the world's No. 3 mobile phone maker, LG was the fifth-largest mobile phone maker by shipments in 2012 after Samsung, Nokia Corp., Apple and ZTE Corp., according to market research firm IDC.

Ghana FA Approves Kwesi Appiah's Stay As Black Stars Coach

The Ghana Football Association says head coach Kwesi Appiah will continue his work despite failing to win the 2013 Africa Cup of Nations.

There were calls for his removal as the ex-Ghana captain struggled to improve the tactical play of the team.

Ghana laboured to beat less-fancied Cape Verde in the quarter-final and were outclassed by Burkina Faso in the semi-final which they lost 3-1 on penalties after drawing 1-1 after extra-time.

But the Executive Committee after analysing the technical report for the Black Stars abject display, thinks Appiah must see through his two-year contract.

?We reviewed Ghana?s participation at this competition and are very quick to admit that the performance fell below the expectation of everyone of us,? Ghana FA President Kwesi Nyantakyi said at a press conference on Friday.

?We render an unqualified apology to all Ghanaians. Very useful lessons have been drawn.

?We also looked at the coaching department led by the head coach ? Kwesi Appiah. He did very well. However, we think the team could have done better. ?We are looking at strengthening the technical team to enable them do better in future tournaments.?

Appiah?s next assignment will be against Sudan on 24 March in a 2014 FIFA World Cup qualifier.

I am remarkably proud of our soccer nation today.

Going way back, I have always thought of soccer fans as a slightly more enlightened breed. Historically you cannot have worn the soccer label in this country without some ability to think for yourself; there was always a ninny out there telling you to get in line and support the ?traditional? American sports.

Friday proved it, when a person previously reluctant to be the best version of himself brought out the very best side of the collective U.S. soccer supporter nation.

Robbie Rogers did something on Friday that took tremendous courage, coming out as a gay man. The American soccer supporters reacted with an overwhelming, inspiring show of support.

Men?s professional sports remain hard-wired into a certain machismo and some corresponding old ways of thinking when it comes to matters of women and sexuality. Individually, we may have become more enlightened and permissive as a society, but evolution within a group dynamic has been harder to come by.

Believe it: what Rogers did took vast stores of backbone.

Even at the highest levels, they did more than just let Rogers know what he did was OK; they acknowledged the breakthrough and the bravery:

Rogers has appeared 18 times for the full national team. That?s exactly what helped make this so significant and newsworthy; Rogers was hardly some obscure figure in the game, once among the most promising young American talent. A 2008 Olympic team member, the speedy left winger quite nearly landed a World Cup roster spot back in 2010, just as he turned 23.

From the playing community, the outpouring was nothing short of inspirational, so much of it delivered publicly via Twitter, so many punctuated by a hashtag of earnest admiration and understanding: #respect

And so many were more than just ?We got your back.?? Longtime U.S. goalkeeper Kasey Keller, for instance, said what was on so many minds, something becoming more and more evident as the public support mounted. ?The bravery of Robbie Rogers in commendable, I hope he realizes that he doesn?t need to retire. He will be more supported than he knows?

MLS players gathered in Arizona for a preseason tournament were scheduled for a round of video interviews, so they took the opportunity to support Rogers on camera.

The Seattle Sounders did a video of their own. That was capped with an MLS public service message where prominent players, including Landon Donovan and Dwayne De Rosario, advised that the league was a no-bullying, no-racism, no-sexism and no-homophobia zone. It also included a statement of support from Marc Burch, who was caught on camera last year in bigoted moment. (Burch subsequently and profusely apologized for his poor choice of words.)

Players from the league champion LA Galaxy voiced their support.

Like Burch, Galaxy midfielder Colin Clark had a particularly bad moment in 2012. He was suspended early last year for directing a homophobic slur toward a young ball boy (for which he went out of his way to humbly make amends). So Clark?s show of support particularly resonated.

Meanwhile, the support from fans was similarly overwhelming ? and overwhelmingly positive. Even Rogers was taken aback.

Colleague Brian Straus from The Sporting News, also wrote of the stunning stream of ?support. He eloquently nailed the U.S. soccer fan dynamic here that creates a more accepting collective.

Thanks to American soccer?s unique demographics, there likely is no sports league in this part of the world more prepared to accept an active gay player than MLS. Soccer remains somewhat counter culture in the U.S. and Canada. MLS fans often are young and urban. Many of the league?s players are well traveled or well educated. The ?New America? that so many pundits discussed during last fall?s presidential election?diverse in some ways, cosmopolitan in others?is far more likely to embrace soccer than the old.

We all deserve to be the best that we can be. No one should be relegated to the outer markers, circling the airport, afraid to land at the fullest version of themselves.

American soccer at large took the opportunity to remind Rogers of that, and tell him that we?re all good here.

(AP) ? The White House is circulating a draft immigration bill that would create a new visa for illegal immigrants living in the United States and allow them to become legal permanent residents within eight years, according to a report published online Saturday by USA Today.

President Barack Obama's bill would create a "Lawful Prospective Immigrant" visa for the estimated 11 million illegal immigrants living in the United States. The bill includes more security funding and requires business owners to adopt a system for verifying the immigration status of new hires within four years, the newspaper said.

USA Today reported that the bill would require that immigrants pass a criminal background check, submit biometric information and pay fees to qualify for the new visa. Immigrants who served more than a year in prison for a criminal conviction or were convicted of three or more crimes and were sentenced to a total of 90 days in jail would not be eligible. Crimes committed in other countries that would bar immigrants from legally entering the country would also be ineligible.

Those immigrants facing deportation would be eligible to apply for the visa, the newspaper reported. Immigrants would be eligible to apply for a green card within eight years, if they learn English and U.S. history and government, and they would later be eligible to become U.S. citizens.

Last month a bipartisan group of senators announced they had agreed on the general outline of an immigration plan. For his part, Obama has said he would not submit his own legislation to Congress so long as law makers acted "in a timely manner." If they failed, he said, "I will send up a bill based on my proposal and insist that they vote on it right away."

Clark Stevens, a White House spokesman, said Saturday that Obama still supports a bipartisan effort to craft a comprehensive immigration bill. "While the president has made clear he will move forward if Congress fails to act, progress continues to be made and the administration has not prepared a final bill to submit," he said in a statement.

Sen. Marco Rubio, the Florida Republican who has been crafting immigration legislation, derided the draft bill as described by the newspaper as "half-baked and seriously flawed" and said it was disappointing because it repeats what he called failures of past legislation. He also said the White House had erred in not seeking input from Republican lawmakers.

"If actually proposed, the president's bill would be dead on arrival in Congress, leaving us with unsecured borders and a broken legal immigration system for years to come," Rubio said in a statement.

Ali Noorani, executive director of the National Immigration Forum, described the draft bill as a "very moderate" proposal. While the path to citizenship was welcomed by Noorani, he said not enough attention was being paid to future immigration.

"Commonsense immigration reform must include a functioning immigration system for the future," Noorani said in a statement. "Reform does not begin and end with citizenship and enforcement alone."
